General Terms and Conditions of Sale

The following list summarizes the terms used in these General Terms and Conditions of Sale (GTCS):

These General Terms and Conditions of Sale (GTCS) apply to sales of services concluded between the PUBLISHER of the SITE and the CLIENT.

ARTICLE 1: Purpose

1.1. The purpose of these GTCS is to set the conditions under which the PUBLISHER undertakes to sell services, detailed as follows:

1.1.1 The GALLERIES may publicize EXHIBITIONS, intended for VISITORS, and VIRTUAL EXHIBITIONS, intended for COLLECTORS and ARTISTS, and search for COLLECTORS and ARTISTS.

1.1.2 COLLECTORS and ARTISTS may explore the COLLECTIONS of the GALLERIES, through the EXHIBITIONS and VIRTUAL EXHIBITIONS published by the GALLERIES, in order to contact the GALLERIES.

1.2. The PUBLISHER makes available to the CLIENT all the means, including forms, that they may need to benefit from the services. However, the PUBLISHER cannot guarantee the CLIENT that the searches carried out by the CLIENT will automatically produce results, nor that the results correspond to their expectations.

ARTICLE 2: Contractual field

2.1. These GTCS express the entire agreement of the parties.

2.2. In the event that any of the provisions of these GTCS are declared null and void or unwritten by a court of competent jurisdiction, the other provisions shall remain in full force and shall be interpreted in a manner consistent with the original intent of the parties.

2.3. The PUBLISHER may modify these GTCS at any time. The applicable GTCS are those that are available online on the site at the time of ordering. The CLIENT acknowledges and accepts them, without reservation, by checking the box provided for this purpose before confirming their order.

ARTICLE 3: Price of services

3.1. Prices do not include taxes.

3.1.1. GALLERY:

One-year subscription: 120 euros

Optional OFF-SITE Pack of 15 units: 50 euros

In the framework of its subscription, a GALLERY:

The credit amount is reduced by one unit each time a new artist/discipline combination is registered in the SITE database.

The credit amount is reduced by one unit each time the address associated with an artist/discipline combination is changed after the start date initially recorded in the SITE database.

When the credit is used up, the GALLERY may purchase an OFF-SITE package.

If the GALLERY deletes an OFF-SITE EXHIBITION prior to the start date recorded in the SITE database, the corresponding credit(s) will be credited back.

If the registration of an OFF-SITE EXHIBITION results in a negative credit balance, this balance is deducted from the credit that is again available to the GALLERY when it extends its subscription or purchases an OFF-SITE pack.

3.1.2. ARTIST and COLLECTOR: One-year subscription, 30 euros

3.1.3. A VAT rate may apply to the amount excluding VAT, depending on the CLIENT's location.

3.1.4. The billing currency is the Euro (EUR). The CLIENT whose local currency is not the Euro acknowledges that the equivalent in their local currency of the invoiced amount may change between the moment when they pay on the SITE and the moment when their bank account is debited for this payment and that they may incur additional expenses charged by third parties, for example exchange fees. The PUBLISHER never applies additional expenses to the amount indicated to the CLIENT at the time when they place their order and thus cannot be held responsible for any such additional expenses applied to them.

3.2. Subscriptions are not automatically renewed. The CLIENT must therefore extend their subscription themselves. An e-mail is sent to them to this effect before the end of their subscription.

3.3. The PUBLISHER reserves the right to modify its prices at any time without notice. The applicable price is that which is indicated on the SITE at the time of ordering.

3.4. By default, the payment of the prices of the services is made online, at the time of the ordering, by credit card and for the total amount of the order. Accepted credit cards are Carte Bleue, Visa, Mastercard, American Express and China UnionPay. The PUBLISHER does not collect nor store any banking data of the CLIENT. For other methods of payment (transfer, check), the CLIENT is invited to contact the PUBLISHER.

3.5. Any special offers are indicated in the Fees section of the SITE homepage.

ARTICLE 4: Ordering and invoices

4.1. Contractual information is given in French.

4.2 In accordance with the provisions of the Civil Code relating to the conclusion of the contract in electronic form, the sale only reaches a valid conclusion once the CLIENT has had the opportunity to verify the details of their order and its total price, to correct any errors, and then to confirm their acceptance. The CLIENT places an order on the SITE after having read and accepted these GTCS and (if applicable) the special conditions of sale applicable to certain services. They are then automatically directed to the payment platform.

4.3. The PUBLISHER acknowledges receipt of the order by email and sends an invoice to the CLIENT, in PDF format, by the same process.

ARTICLE 5: Liability

The PUBLISHER can in no way be held liable if the delay, poor execution or non-performance of the contract is attributable to the CLIENT or is related to circumstances outside the PUBLISHER's control.

ARTICLE 6: Withdrawal period

In accordance with Article L. 221-28 of the Consumer Code, the withdrawal period is not applicable to the services provided by the PUBLISHER, because (a) the services are fully executed before the end of the withdrawal period, (b) the services begin as soon as the CLIENT validates their order and (c) the CLIENT expressly waives his right of withdrawal by means of a check box provided for this purpose in the form used by the CLIENT to place the order.

ARTICLE 7: Applicable law and competent jurisdiction

All disputes relating to the sale of services concluded by the PUBLISHER, as well as the application or interpretation of these general conditions of sale are governed by French law.

ARTICLE 9: Applicable language

In the event that these conditions are translated into languages other than French, the conditions written in French shall prevail.
